St. Joseph County prosecutors filed a petition alleging delinquency—the juvenile equivalent of a criminal charge—for attempted murder. For an adult, attempted murder would be a Level 1 felony, the South Bend Tribune reports.

Police were called to the 10000 block of Conover Drive just after 11 p.m. Feb. 22. Trooper Matt Makowski suffered a single gunshot wound to his lower extremities, according to a news release. Makowski was off duty at the time of the shooting.

The prosecutor’s office said it would not release details about the gun used and whether it was the officer’s service weapon because of the ongoing investigation.
