Video: Suspect Gets 26 Years for Attempted Murder of Deputy

Daniel Roy Smith, 57, was sentenced to 26 to 32 years after taking part in a shootout with Guilford County Sheriff's Corporal Wes Mecham on August 29, 2009.

A North Carolina man has been sentenced to at least 26 years in prison for firing at a sheriff's deputy who had stopped him for questioning.

The deputy had stopped Smith at around 4 a.m. Dashcam video released by the sheriff's office shows Smith pulling out a gun, moments after the deputy asked if he had left a halfway house. The deputy had also told Smith the agency was checking on a possible outstanding warrant.

While backing away from Smith, the deputy tripped and fell in the middle of the road. Smith fired twice point blank, missing the deputy, who returned fire and struck him five times. Smith then fired three more shots, which missed the deputy.
