A Maryland county circuit court judge has ruled officers can't expect privacy while performing enforcement duties on or off duty when communicating with subjects, reports the Washington Post.
Harford County judge Emory Pitt also dismissed wiretapping charges against Anthony Graber, who was stopped by off-duty state trooper Joseph Uhler while speeding on his motorcycle. Graber recorded the video and audio of the stop and posted it on YouTube.
The state's attorney general had filed charges accusing Graber of a wiretapping felony and using an illegal recording device. While those charges were dismissed, Graber will still face the traffic charges.
