Former Cpl. Jay Cicinelli was seeking to have his trial seperately from co-defendant and former Officer Manuel Ramos. Judge William Froeberg denied that request.

A third co-defendant charged in the death of Thomas is scheduled to appear before Judge Froeberg on July 12. Former Officer Joe Wolfe has requested that charges be dismissed against him, reports NBC Los Angeles.

Wolfe and Cicinelli have been charged with involuntary manslaughter and excessive force, while Ramos has been charged with second-degree murder and involuntary manslaughter.

Thomas died as a result of an altercation with five Fullerton PD officers near a transit center on July 5, 2011.
