Utah Troopers Want Re-hearing of Fallen Officer Cross Ruling

The Utah Highway Patrol filed a petition asking for re-consideration of a 10th Circuit appeals ruling that 14 roadside crosses memorializing the line-of-duty deaths of its troopers were unconstitutional, the Deseret News reports.

Col. Scott Duncan, superintendent of the Utah Highway Patrol, and John Njord, executive director of the Utah Department of Transportation, filed the petition, saying the crosses were not chosen as a religious symbol, but merely to "convey the message of death, honor, sacrifice, and safety."

In 2005, American Atheists Inc. sued the Utah Highway Patrol and the Utah Highway Patrol Association, a private law enforcement group that supports troopers and their families, to get the crosses taken off state lands.
