Two of the three men who attempted to rob an armored truck in Pinole, Calif., and exchanged fire with police officers have been charged in connection to the Wednesday incident.
Freddie Lee Daniel, 24, has been charged with murder in the death of his brother, Pierre Demarrio Daniel, 25, who was shot dead by Pinole PD's Officer Mike Pistello after the attempted holdup outside a Wells Fargo Bank in a shopping center.
In California, a suspect can be charged with murder under the provocative-act doctrine, which holds an accomplice responsible for the death of a crime partner.
Pinole PD's Officer Brian "Justin" Takacs is recovering from injuries he suffered in the gunfight with the Daniels and William Fuller, the alleged getaway driver.
