Attorneys for Maryland States Attorney Marilyn Mosby are arguing that she cannot be sued for malicious prosecution by five Baltimore officers who were charged with offenses stemming from the Freddie Gray in-custody death because she has immunity. All five officers were cleared of the charges and have been reinstated to the force.
Arguments on the lawsuit are being heard before the 4th U.S. Circuit Court of Appeals in Richmond. Mosby is asking the court to overturn a judge’s decision to allow parts of the officers’ lawsuit against her to go to trial, the Associated Press reports.
The officers’ lawyers say she maliciously prosecuted the officers to ease public unrest in Baltimore after Freddie Gray, a young African-American, suffered a fatal injury in a police van. Three were subsequently acquitted and Mosby dropped the remaining cases.
