A New York Police Department squad car pursuing two men on an illegal motorcycle accidentally rear-ended the dirt bike, killing one and injuring the second man. That man is now suing the department.
Video of the August crash was provided to Fox News by the attorney of Adalberto Gonzalez, who was charged with reckless endangerment, resisting arrest and reckless driving. Eddie Fernandez, who was driving the unlicensed motorcycle without a helmet, was killed in the crash.
Surveillance footage from the incident shows the cruiser striking the motorcycle.
