South Dakota's attorney general and criminal investigation division have cleared a highway patrolman who fatally shot a man who told a dispatcher he wanted to kill a law enforcement officer.
Patrolman Todd Albertson fatally shot Cody Engen on Sept. 6 in the tourist town of Custer, as Engen walked toward the officer with a handgun. He ignored three orders to drop the gun. The officer fired 14 rounds from his duty-issued .223 rifle at Engen, striking him three times.
