Prosecutors declined to file charges against Kenneth Moreno stemming from a 2009 search of his Ninth Precinct locker following his arrest on the rape charge.
Moreno and Franklin Mata were acquitted on the rape charge in May , but face jail time after they were found guilty of official misconduct. Following their acquittal, Moreno ripped prosecutors , saying they bowed to political pressure in taking a weak case to trial.
