Judge Denies Request to Acquit Baltimore Officer

A Baltimore judge has denied a request to acquit an officer charged in the arrest of Freddie Gray, reports the Associated Press .

Baltimore Police Officer Edward Nero is charged with assault, misconduct in office, and reckless endangerment in Gray's arrest last year and death a week later.

Nero's attorney made the request Monday after the state rested its case. Prosecutors called 14 witnesses, including co-defendant and fellow Officer Garrett Miller.

Gray died after his neck was broken in the back of a police van while he was handcuffed and shackled, but unrestrained by a seat belt. Prosecutors say Nero, Miller, and another officer illegally arrested Gray without probable cause, and officers were negligent when they didn't buckle him in.

Nero's attorney says his client was present only after Gray was detained and in handcuffs.
