An officer with the North Miami Police Department was found guilty of culpable negligence—a misdemeanor—but not guilty of other felony charges in a 2016 incident involving an Autistic subject and his caregiver.
According to USA Today, Officer Jonathan Aledda was found not guilty of two counts of attempted manslaughter in the shooting of Charles Kinsey, the caretaker for Arnaldo Rios Soto.
During the incident, Officer Aledda responded to the call of a man acting erratically. When he arrived to the scene the two men were in the middle of the street.
The officer reportedly mistook the metal toy truck Soto was holding for a gun and fired an undisclosed number of shots with his rifle, striking and wounding Kinsey in the leg.
Officer Aledda faces a penalty of up to one year in prison.
