The U.S. Supreme Court on Wednesday appeared skeptical of a Kansas man's attempt to overturn his conviction for killing Greenwood County Sheriff Matt Samuels in January of 2005.

Justices debated whether to uphold a Kansas Supreme Court decision that threw out Scott Cheever's capital murder conviction and death sentence, reports the Associated Press .

The Kansas court had ruled that Cheever's rights had been violated by prosecutors using a court-ordered mental evaluation from a different trial against him.

A decision is expected early next year.
