A Madison, Wis., police officer will not face criminal charges for fatally shooting 19-year-old Tony Robinson, District Attorney Ismael Ozanne said Tuesday, reports the Wisconsin State Journal.
The shooting did not violate criminal law, Ozanne said, as the officer used deadly force against Robinson in self-defense when confronted with an imminent threat of death or great bodily harm.
Ozanne announced his decision at a press conference 66 days after the officer shot and killed Robinson in the cramped stairway of a Near East Side apartment home on the night of March 6.
Police have said Robinson, who was unarmed, assaulted the officer before he was shot, punching the officer in the head and knocking him off balance. The officer had been called to the home for reports that Robinson was running in traffic and had battered two people.
Ozanne made his decision after reviewing a state investigation of the shooting. The Division of Criminal Investigation led the inquiry to comply with a state law requiring outside investigations of officer-involved deaths.
