The U.S. Court of Appeals has declined to review its decision to toss out the death sentence against a convicted cop killer due to prosecutorial error.
A request by the Brooklyn U.S. Attorney's office to rehear the case against Ronnell Wilson was rejected Tuesday by a deeply divided court.
Four judges wrote a strongly dissenting opinion to the decision, arguing the death sentence had been properly reached and should not be overturned based on error found "in a handful of words buried in the government's summation."
Wilson was convicted in Brooklyn Federal Court of murdering undercover NYPD Detectives Rodney Andrews and James Nemorin during a gun buy-and-bust operation in Staten Island. The jury sentenced Wilson to five death sentences to be carried out by lethal injection for his cold-blooded crimes.
