Seattle Police Officer James Lee has been charged with fourth-degree assault for allegedly kicking a teenage suspect inside a convenience store in October.

Officer Lee, 42, is the first Seattle officer charged, following a Department of Justice civil rights probe into the department triggered by a complaint from the ACLU.

The charge stems from an Oct. 18 incident in Joe's Mart in downtown Seattle that was captured on surveillance video and widely broadcast on television and Internet sites. In the video, Officer Lee is seen kicking teenager Dvontaveous Hoston, who was suspected of trying to rob an undercover narcotics officer.
