The U.S. Supreme Court on Wednesday appeared skeptical of a Kansas man's attempt to overturn his conviction for killing Greenwood County Sheriff Matt Samuels in January of 2005.

Justices debated whether to uphold a Kansas Supreme Court decision that threw out Scott Cheever's capital murder conviction and death sentence, reports the Associated Press.

The Kansas court had ruled that Cheever's rights had been violated by prosecutors using a court-ordered mental evaluation from a different trial against him.

A decision is expected early next year.
