A North Carolina doctoral student wounded in the Empire State Building shooting sued the NYPD, arguing that officers need better training to deal with such confrontations in the future.

Chenin Duclos, 32, was one of nine bystanders hit by police bullets, ricochets or  fragments in August, when officers shot and killed Jeffery Johnson in front of the iconic landmark. Johnson had murdered his former boss and pointed a handgun at officers before he was killed.

Duclos' lawsuit, filed Tuesday in Manhattan's state Supreme Court, accuses the department and officers of being "grossly negligent" by firing 16 shots on a crowded street outside one of the world's largest tourist attractions, reports NBC News.

"They consistently fail to properly train employees and officers in the settings they will encounter," said Amy Marion, an attorney representing Duclos.
