The family of a woman who was fatally shot by a Border Patrol agent after she struck him with her car filed a claim to sue the agency for wrongful death.

Agent Justin Tackett, who was working undercover, was forced to use deadly force against Valeria "Munique" Tachiquin Alvarado on Sept. 28. Alvarado was leaving an apartment known for drug activity when she struck Agent Tackett with her car, carrying him on her hood while he yelled at her to stop. Agent Tackett shot her through the windshield, killing her.

The Chula Vista Police Department is continuing its investigation into the shooting, reports the San Diego Union-Tribune.
