A day after a New York City police officer was convicted of sexually attacking a woman at gunpoint last August, a judge declared a mistrial on Wednesday on the remaining two counts of rape and related charges that had left the jury deadlocked, reports the New York Times.
Despite the jury’s impasse, the officer, Michael Pena, faces a possible sentence of life in prison after being found guilty on Tuesday of criminal sexual assault and predatory sexual assault.
The 25-year-old victim broke down in tears as the jury announced that it could not reach a verdict on the rape charges. She was escorted through a side door of the courtroom by supporters and members of the Manhattan district attorney’s office.
