Supreme Court Validates Tampa PD's Miranda Warning

The U.S. Supreme Court has overtuned the Florida high court's ruling that the Tampa Police Department misled a suspect who illegally possessed a firearm while reciting a Miranda warning, TampaBay.com reports.

Kevin Dewayne Powell, who was arrested in August 2004 on a charge of being a felon in possession of a firearm, informed officers he possessed a handgun after police recited their standard Miranda warning to him.

The majority said officers effectively communicated that Powell could consult with an attorney before answering any particular question and that he could use this right while the questioning was under way.
