Oregon Trooper Shot 12 Times in 2016 Sues County for $20 Million

A state trooper shot 12 times by a murder suspect is suing Washington County's 911 system, the sheriff and others, contending dispatchers failed to alert officers that James Tylka was armed, suicidal and had just shot his wife when they radioed for police to find him on Dec. 25, 2016.

Nic Cederberg, the only state trooper patrolling in Washington County, lacked critical information when he made tactical decisions to chase Tylka "that he would not otherwise have made, was exposed and subjected to an unanticipated lethal attack and suffered critical, life threatening and permanently disabling injuries,'' the federal suit says.

Cederberg is seeking $20.6 million in damages for past and future pain and loss of his quality of life. His wife, Portland police Officer Haley Shelton, who provided five months of around-the- clock care for her husband, is seeking $10 million in damages, OregonLive reports.

Kelly Dutra, director of Washington County Consolidated Communications Agency, said Tuesday she couldn't comment about the pending litigation.

Cederberg remains a trooper with state police, working a modified assignment to accommodate his recovery,  state police Capt. Timothy Fox said.

The law suit is an unfortunate resolution to this however when vital information is purposely omitted by dispatch the entire picture changes. I have had this happen to me on several occasion in critical situations fortunately all worked out however the dispatcher was never held accountable. I am sure that there will be individuals in this profession who will chastise the Trooper and his wife for filing the law suit. I can only suggest that unless you have been in a similar situation you lack standing.

We recieved a call from dispatch for an 'ATL' Attemp to Locate, a male subject that was seen recently in our patrol area and the dipatcher said, "...no weapons, ...he has a knife'. My partner and I just looked at each other with that "what do you consider a knife....? Look."

As a officer I had a dispatcher at our VA Hospital that could not operate the MDL part of the computer and would have to repeat the license plate numbers four and five times. I loved her to death but she was dangerous for us to wait for checks of the plate and the subjects.

Well said Trigger. I too had a close call. Dispatch sent me to a "beer run". I enter the &-11 while a male customer is at the cash register. He leaves and I contact the clerk about the theft. The clerk stated that he didn't want to go with the suspect even though he had a handgun and told him to. I asked if he told dispatch about the gun. He said "yes, 3 times". It turns out after listening to the taped call, dispatch was told 3 times about a gun. Lucky for me the customer was not the suspect. No discipline for the dispatcher. I don't work there anymore. TX LEO

I could not agree more. Not passing on information is not just dangerous but it is critical for proper threat assessment. If I were on the jury I'd award a much higher amount that that of the amount requested.

I've continued my career after a shooting that has left me with pain and troubled mobility. I don't know what happened or why but I wish Trooper Cederberg as speedy and complete a recover as is possible.
