Baltimore Chief Wants Mandatory Jail Time for Suspects Carrying Illegal Guns

Baltimore Police Commissioner Kevin Davis wants the General Assembly to pass legislation requiring that people who are caught with a loaded handgun be locked up for at least a year.

As Baltimore battles a deadly surge in gun violence, Davis and two lawmakers from the city are pushing a bill to dramatically enhance the penalty, statewide, for carrying a loaded, illegal gun.

"If we're going to win this conflict, there has to be a consequence to someone making a decision to arm himself with an illegal firearm," Davis told the Baltimore Sun. "Right now, that consequence is nonexistent."

The legislation would convert the current sentence of up to 30 days to a mandatory year or more in jail. A second offense would be a felony that would require at least five years behind bars. The bill would strip from judges the discretion to reduce those sentences.

All mandatory minimum should be abolished. The US leads all nations in with prison population, on scene when you think about place such as China, Russi, N. Korea. Countries that regularly oppress their citizens.

@Tom: Your comment is quite laughable. It's is a fact that the US has 5% off the worlds population yet houses 25% of the worlds prison population. There is something very wrong with that picture. Most of the obscene prison growth fueled by the failed war on drugs and the tough on crime era of the 80s resulting in the creation of the US prison industrial complex. Secondly, I did not say that people that commit crime don't deserve prison time, I stated that I oppose mandatory minimums. Mandatory minimums have perverted our justice system to the point where over 95% of cases are plea bargained. Prosecutors routinely stack charges against the accused precisely to prevent trial and even force some innocent to plead guilty to avoid the risk of trial. Now tell me where I am wrong.

Hey Lenny, you are so special. The alternative to the one year mandatory sentences could be that these idiots continue to carry the guns, real or look alike, and get shot and killed by LE. Oh wait, you have bitched about that as well. What really sucks is that LEO'S are forced to shoot these folks, and contrary to your belief, we really don't want to so that. At least the Chief is trying to do something to keep these dolts from going out and getting themselves killed. Also Lenny, there are a multitude of reasons other counties prison population is not as high as the U.S.
For example; The authorities are allowed to take care of business without a bunch of cry baby liberals complaining every time someone's little feelings get hurt. Second, guess what the punishment is in China, Russa, N. Korea for weapons, theft, robbery, burglary, rape, drug dealers? Finally, I don't even have to mention the third, most everyone on here already knows what that is. Ol'Lenny boy, if your going to be a critic then please do some book learnin' first or at least thinking. Ohhhh, I can't wait for your incredibly uneducated, nonsensical response.

I think that Leonard has a clue, not one that is worth anything though. We have the highest population of prisoners why? Because our prosecutors and our judges refuse to do their jobs. They continue to plea bargain and the judges continue to accept it. I believe if you stopped plea bargaining, you will be sending our repeat offenders to prison and by doing that eliminate them being repeat offenders. If you look at the criminal histories of the scumbuckets killing LEO's and civilians you are most likely going to find that most if not all of them have recently been arrested plea bargained to less than minimum and that they were probably released within the last year. One of them was on probation, had been arrested for felony and had been released out on the streets. What judge has any intelligence would do that?

Could it be that the high population in prison is possibly due to the violent nature of the people. And maybe because our prisons are so lenient in the freedoms given to the inmates compared to Russia, China, N. Korea or the middle east and other countries, creates an atmosphere of not fearing going to prison. There is no deterrent to a harden criminal or gangbanger in going to prison, cause he will be with his homies, has his dope and will bang in the joint. We have a drug problem in this country because we allow it, unlike other countries in Asia, middle east, Russia, Balkan nations, Africa and S. America where possession of drugs is a capital offense. They don't play games with offenders, but we are civilized. We have people who will stand up for criminals who get caught with a firearm, they know that they can not have, and scream leniency and will blame the gun, not the person for all this shootings and acts of violence with a gun.

If you want to know why the other countries you named have less repeat offenders (other than the fact that they execute them), read "One Day in the Life of Ivan Denisovich". That might give you a clue as to how spoiled our prisoners are. AND...the reason for mandatory sentences is bleeding heart liberal judges who keep turning these criminals back out on the street to further victimize innocent citizens. If you'd like to send us your address, I can arrange for some of these people you so vigorously defend to drop by and victimize you so you will understand what the truly innocent people in our society go through at the hands of this filth daily.

Hey guys...how about we take care of this troll problem? They are only stalking our board because they want to get a reaction from us and get under our skins like the parasites they are. SO...how about we just continue with our own conversations instead of responding to the trolls, ignoring them and their idiotic comments as if they aren't there? Eventually they will go away because that will take all the fun out of it for them. Just a suggestion.

I have no problem with the maximum penalty being raised to 1 year..that seems fair.
However, the mandatory minimum sentence is wrong...these typically just sweep everyone under the same rug. We, the taxpayers pay judges for a reason, to use their best judgement to find a fair sentence.
--A drug dealer who carries the gun, has probably used it...yeah he deserves 1 year.
--What about the guy who went to the range, but left his gun in the car with a magazine inserted (even with no bullets that is considered loaded in most states). Now his wife, or 16 yo kid takes the car to the store for a quick trip. Cop tickets the car for illegal parking, and asks to search. The driver says that is fine...I have nothing to hide. Cop finds the gun. Does this person deserve 1 year in jail?
