N.Y. Officer Shot and Killed With Own Weapon, Suspect Dead

Officer David Smith had just started his Monday patrol shift, when at 7:03 a.m., he was dispatched to a disturbance at Southern Tier Imaging on Harrison Street, reports

Within three minutes, there was a second 911 call of shots fired.

In that time, Smith had pulled up on the scene when he was approached from behind by a man running and yelling with his arms in the air, leaving Southern Tier Imaging. He then reached into Smith’s vehicle and wrestled away the officer’s .40 caliber duty weapon in a struggle.

Outside the building near the UHS Wilson Medical Center campus, 43-year-old Smith was fatally shot twice with his own duty weapon. He was pronounced dead within an hour.

Officer David W Smith, In God's eyes there is no greater price that a man shall pay than be willing to lay down his life for another. Your shift on earth is finished, your new one begins with a walk down the golden street God made for you. R.I.P. Officer D.W. Smith. It is a reminder that all of you active duty L.E.O's. must always be on the watch for these types of sh_t heads. Please be careful out there and watch all your clocks. Mainly your 6 O'clocks. May you be safe Brothers/Sisters in Uniform and be able to retire as I was. May God be with this Officer's Family, Agency Family, & Friends.

My heart goes out to the Smith family. It is always so sad to see those who are there to protect us lose their life trying to save ours. And People say law enforcement officers are over paid. If the make it to retirement they are lucky. My closest friend did, but I read this and think how lucky her son was that she never got injured on the job. My prayers are with the Smith family.

One of my academy classmates was killed with his own weapon. His vest was in his squad car where he had placed it after taking it off following rolecall inspection. He then caught his last call, an in-progress B&E!
