No criminal charges will be filed against the New York transit officer who mistook an off-duty Nassau County police officer for a suspect and fatally shot him in March, reports the New York Times.
The officer, Geoffrey Breitkopf, was shot by an officer with the Metropolitan Transportation Authority, Glenn Gentile, on March 12.
Officer Breitkopf was responding in plainclothes to back up officers who fatally shot 21-year-old Anthony DeGeronimo, a man who had charged officers with knives in his hands and strapped to his body.
