Former BART Police officer Johannes Mehserle testified in federal court that he feared an attack from a combative subject against himself and another officer during a confrontation in late 2008.
Kenneth Carrethers, 43, of Oakland is claiming officers Mehserle and Frederick Guonzon injured him and violated his constitutional rights by using excessive force in the confrontation at BART's Coliseum/Oakland Airport station on Nov. 15, 2008, reports the Silicon Valley Mercury News.
The incident occurred six and a half weeks before Mehserle shot and killed Oscar Grant at Fruitvale station on New Year's Day.
