Accused Calif. Cop Killer Charged with Capital Murder

Capital murder charges have been filed against the bank robbery suspect who allegedly shot Vallejo (Calif.) Police Officer James Capoot after a foot pursuit.

Henry Albert Smith, 37, has also been charged with intentionally killing Officer Capoot by "lying in wait," reports the Times-Herald. Smith declined to enter a plea when charges were presented in court on Monday.

Prosecutors have not said whether they would seek the death penalty against Smith, and have released few details about how the officer was shot. Officer Capoot didn't fire his service weapon.

The highly decorated officer was shot Nov. 17, after a foot pursuit. The officer had used a PIT maneuver to disable the vehicle being driven by Smith, who was taken into custody by other officers using a stun gun.

Hundreds of well-wishers attended a candlelight vigil for Capoot on Sunday at City Hall.

No one need ask me how I feel about this; the punishment should be extended to premeditated attempted murder too. Not that the FBI would investigate such heinous crimes committed in cold blood. Oh that's right VA Cops are officially disposable to the Veterans Affairs. Stop me when I lie FBI

This is yet another tragic loss to law enforcement. There should be no question in anyone's mind that the death penalty should result from this cowardly act. Peace and healing for his family and friends.

With moon beam Brown at the helm in Calif backed up by the law enforcement loving ACLU, capital punishment for this suspect is anything but sure.

I hope he is put to death but I want him to suffer like us, his family is. Lethal injection is too kind for this man.

I am so sorry for the loss a life is a life and he did not deserve to die. I myself think giving someone the death penalty is weak. California is a weak state when it comes to that. we wont kill our own even if they are animals and have it coming, but in california when senteced to death they sit in a cell get 3 meals a day and commisary if they have the support of family they get letters phone calls color cable tv and a licfetime of appeals, example Richard Davis he took a childs life but yet hes still here being protected by our government, like Scott Peterson killed his wife and unborn child. still he sits alive and well the night stalker too Richard Rameraz? and they will sit there die of old age before hes put to death. If this was any other state they all would be 6 feet under right now. another example of tht Tim Mcvie he was dead not too long after he killed all those people. Again california is weak, instead of death give these fools life without, throw them in gp and see how long they last. Not long I bet Inmate Justice saves tax pyers money and I know a few people that would have no problem takin out a cop killer baby killer etc no problem at all, done deal. As it is now officer Capoots family has to live with the fact that this animal that killed her husband their father will sit there 3 meals a day color cable tv a life behind bars is still living he wakes up everyday officer Capoot wont ever wake up. You do the math is it justice really? I dont think so. Just like a war we will never win they will die of old age before they die by injection!!!!!!!!!! So Sorry about your loss. If Tears could build a stairway and memories made a lane Id walk right up to heaven and bring You HomeAgain!
