N.M. State Police Investigate Trooper Caught Having Sex on Car Hood

New Mexico State Police investigators are working to identify a trooper caught having sex with a woman on the hood of a car while in uniform.

The trooper was captured in images from a surveillance camera set up in a remote area of Santa Fe County to document vandalism. The trooper's act took place at a ranch at the county's western edge.

Two images were released by the Santa Fe County Sheriff's Office and provided to state police investigators. A Chihuahua or other small dog can be seen watching the action.

The state police have placed an officer on leave but have not confirmed that the officer is the same one seen in the photos.

"We are not disclosing the identity of the involved officer at this time," a state police public information officer wrote in an e-mail to POLICE. "Personnel matters are ongoing."

This is deplorable. This same crime has happened where I live and the women who were the victims couldn't report for fear of their well being. The alleged officer is still working for our police force. I hope the video will be caught and prosecuted. Please do not look the other way like my city officials have done.

Actually, Tim is right. I recent Federal Court decision states that the uniform doesn't matter....only if he was on the clock or off the clock. See Rau v. Roberts, No. 10-1476 (8th Cir. 2011). There is no doubt administrative action should be taken, but highly unlikely anything criminal as it relates to simply wearing the uniform if off-duty.

Assuming this is really a LEO and not someone trying to perform for the camera, I think if the LEO was on duty he should be fired. Jailed if it relates to getting the girl out of a ticket. A 30 day suspension if he was off duty.

Its jerks like this that give us a bad name. More than one officer at my department has been caught and fired for this kind of incident. Unfortunately this kind of thing goes on everywhere and these people have to be weeded out as thier caught for the honor of the departments.

I suspect it's more along the lines of what's been said, but there's always the possibility . . .

I'll just start out by saying this is disgraceful. On duty or off it's an embarrassment. I can't imagine many states where it is lawful to have sex in view of the public. If he was off duty getting a quickie in with his girlfriend yes, he deserves a suspension at the least. If he was on duty then he deserves to be permanently relieved of duty. And if it was quid pro quo he deserves prosecution. The job is hard enough when you are out doing the right thing without some fool pulling a stunt like this and embarrassing everyone.

Once you remove the car they were using as a bed. I think they knew the camera was there and preformed in front of it.

What you do in public in the uniform is the big issue here. Unless this guy is part of Thunder From Down Under he has no business doing anything un- becoming in his uniform where others, including a dog can see. What if there were children watching this? Where there is a dog there just might be a child. You disgrace the uniform and the badge, your gone.

The real embarrassment is from places like this that post these things for all of us losers to comment about! All we wanna do is make a big deal about it, right? Personally, if the cop and his ladyfriend have some kinda relationship going on, I would chalk it up to taking a break at work to let off some steam. You know the next car that gets pulled over by him is getting a warning for sure! And what if it were 2 cops getting busy on duty? How do we feel about that?

What a dumb a--! Three things get officers into trouble...whiskey, women and guns. The badge will get you a lot of this stuff, but this stuff will also get your badge! This isn't new-cops have been doing this for years. Go to the Smoking Gun website. You'll see the other photo showing part of his face. They surely know who it is. Cops do this stuff all the time. Gives the good guys a bad name. Obviously, their brain isn't where it should be. What an embarrassment for the department!

I'm troubled by these comments of whether it matters if the idiot was on-duty of off. It doesn't in the public's eye and it shouldn't be an issue. The uniform, whether onduty of off should indicate a symbol of stability and authority. This clown and those who can accept these actions have a lot to do with negative public image.

I wonder if they determined if the trooper had stopped the female for speeding or some other traffic infraction and the trooper told her that if she let him have sex, she wouldn’t receive a ticket. It will be interested to learn the circumstances behind the sex act.

Dana, what crime? Why are you calling the woman (if it is a woman) a victim? You make alot of assumptions about the photo. Might it be consensual sex, off-duty with a girlfriend? And in your story you call someone an "alleged officer" but say he still works for the police department. That makes him an officer, not an "alleged officer."

I find it strange that this is taking place right in the camera's field of vision. If this is a surveillance cam, set up in a specific location, how did the trooper, the female participant, and the vehicle end up at this "specific" location? Did the female plan to make it happen in front of the cam? If the trooper knew there was a cam surveying the area, would he have done it in that "specific" location knowing he would be on camera? Things that make you go hmmmm!

Crime??? Since when is stupidity a crime? Unless he is forcing her then it is just a case of extreme bad judgement. Local girl where I live got pissed at a cop she was "seeing" so to speak. Accused him of rape because she said she was scared of his handgun and was afraid to say no. Jury voted 11-1 to convict. Pled to a lesser charge of sexual misconduct. Career over!!! Jeez!!! Think with the big head please!!!

Maybe it was his girlfriend, ala Clint Eastwood. Seriously, a uniformed police officer on or off duty acts under the color of authority. If he/she abuses the uniform, he/she should be prosecuted to the full extent of the law and dismissed from the force. This is what happens in the military all the time.

Thanks, Mark. That is the distinction between a criminal offense and an administrative offense. I'm around scumbag lawyers all the time and the difference between jail and just lawyer bills is often down to a technicality. Either way, he probably won't be on the recruiting poster this year.....but he might make it into some other publications.....
