California Supreme Court Upholds Death Sentence for 1997 Deputy Murder

The California state Supreme Court yesterday affirmed the death sentence imposed for the murder of a Los Angeles County deputy sheriff, rejecting the defendant’s claim that the special circumstance of killing a peace officer in retaliation for the performance of official duties requires proof of specific acts against the defendant which caused him to form the intent to kill the officer.

The Metropolitan News-Enterprise is reporting the justices unanimously affirmed Kevin Dewayne Boyce’s conviction and sentence on charges of first degree murder, with special circumstances of killing a peace officer in retaliation for the performance of his duties and of murder during the commission of a felony robbery and burglary. Orange Superior Court Judge Frank Fasel imposed the death sentence for the murder of Deputy Sheriff Shayne York.

York was killed at an Orange County salon where he and his fiancée, fellow deputy Jennifer Parish, were going to have their hair styled by Parish’s sister.

According to trial testimony, Boyce and Andre Willis came into the Buena Park salon on Aug. 14, 1997, carrying guns. The men demanded money from the cash register which contained $11.

Court testimony shows that when the defendant learned that Shayne York was a deputy sheriff, he shot him in the head as he lay on the floor.

There was additional evidence that the defendant was a Crips gang member, incarcerated in 1994 at the facility where Deputy York worked. This independent evidence is consistent with the defendant’s remarks to York, and reflects his motive for the murder.

F!@k that cop killing crip piece of crap! I trained Shayne York and his fiancee in the academy. Both were upstanding young people with their whole life ahead of them. This crip coward wasted Shayne in cold blood while he was lying helplessly on the floor. I would volunteer to be on the firing squad, or to pull the electric lever or to cut off his fricking ugly ass head with a rusty hand saw and stick it on a pike, piss on his carcass and burn it! He needs to be erased from the face of this Earth!

It's about 16 years to late already. Cop killers should be tried right away. If found guilty then must have initial appeal done within 9 months. All appeals within 2 years. Decision of & execution done within 3 years.

I am very happy to see that a higher court affirmed the conviction and that the pos gang banger will eventually get death. It may take a while but it will come.

I am very happy to see that a higher court has affirmed facts a lower court and jury found to be true and that the pos gang banger will eventually get the death sentence he so richly deserves.

Dave Sauer, although I agree with the courts decision to execute this murdering SOB...your excessive anger, and need for vengeance only hurts you. You need to calm down, and watch your blood pressure Sir.

Renee, how many deputies have you trained, or were your partners and whom were MURDERED in COLD BLOOD or killed in the line of duty? That's what I thought. Go back to sipping your coffee and leave Sauer express himself. I know how he feels.

CA has some on death row but how long has it been since they actually carried out an execution? Just wondering. Glad this POS got his sentence upheld even though it took way too long. The question now is how long will it take the state to put him to death or will they ever?

.....and I didn't know these deputies Renee, doesn't matter. Angry? YUP.....and I have every right to be just like these "disadvantaged people" who use their life circumstance as a convienant excuse for their actions. Too damn bad Renee if you don't like it.....you can excuse yourself from this forum.
