Chicago Gang Funeral Goers Get Police Pat Downs

The Chicago Police Department will begin patting down attendees of gang funerals to prevent violent attacks, Mayor Rahm Emanuel told CBS News.

"The police department is going to change the way they deal with gang funerals," he said. "If you cannot respect a place of worship, at a time of a funeral, we are going to show a different type of attitude."

The funerals will now be treated as "gang events" by the department.

Rahm should be very careful on this one. If Obama hears about it, he may get upset should any of those searched be Black. Violaton of Civil Liberties...Obama may even say, "If I had a son, he would look like the one being searched." Watch out for Jesse and Al who might get on the wagon. Anything that makes sense, especially if it works, is often denied by Obama.

While Mr. Mather's manner of expression is not all that great, and maybe some of his statements a bit off, there are major legal problems with the expressed plan of action. There is no legal basis upon which such actions can be taken of which I can think, and I have been practicing and teaching in search and seizure for years. This is not going to end well for the city of Chicago.

LOL, least you didn't call for more "gun control laws". I totally agree with Doug M. SERIOUS legal issues. But, Chicago pays millions of dollars a year in settlements and judgements for violating the law, peoples rights, etc., so the poor LEO's will just have to forego raises so that they can follow the illegal (also illogical) policies of the totally ignorant politicans.

Kinda easy, no one will be forced to be searched. Kind of like the airport. If you dont want the TSA all up in your business then Go Greyhound.


no one will be detained and searched that doesn't "consent" to that brief detention and search. just like a pro football game, basketball, Etc...

You know, I am getting so tired of people turning every conversation into a jib at the President or making it a race issue...bottom line is there are more than just "black" individuals in gangs, and as it has been mentioned, there are definitely some civil liberty issues at hand here, and that should be the focus of the conversation....

Mather, your statement wreaks of racial condmenation. Just because we have an African American president, doesn't mean he would or should respond to such actions. This decision is being made on a municipal level, not federal. I would agree with Doug M's statement regarding the legalities of search & seizure. And last i checked, Obama has two daughters and no male children.

Criminals do not abide by the law...that's why they are called criminals,skells,thugs,rapists,murderers,assassins,child molesters,wanna-be-gang-bangers!!! We have to maintain law and order and I don't feel we should entertain any of their winings resulting from this simple preventive proactive gesture!

I think Buck is on to something from a legal perspective. Search & Seizure issues may only arrise if you are 1. Seizing property or persons without probable cause and 2. If persons are being singled out or decriminated against in the course of the search. If everyone is searched simply as a matter of entry requirements, much like athletic events, governement venues, etc. and no action taken such as arrest or permanent seizure of property or persons, then is the 4th amendment violated? And Trip some point we have to cease the philisophical arguement, (papers please) and deal with the reality of the dangers gangs pose to the general public. Gangs, unlike hispanics or any other ethnicity, are not a protected class thus we must take steps to offset their negative influence on society; at funerals or anywhere else they may be. Unless you see some good produced by gang membership. I'm all ears....

I am angered and feel great concern for my Chicago Police Family, many of whom will end up as defendants in federal lawsuits if this policy is enacted. Rahm's previous employment as Chief of Staff for Dictator Obama allowed him to circumvent Congress and the Constitution on a national level. However, Chicago is famous for wealthy attorneys, many of whom have acquired that wealth by suing the City Police Department. If Chicago police in uniform armed with their assault rifles interfere with funerals, by radomly stopping and frisking mourners, in "Minority" communities, and face reality that is where the gangbangers live and kill each other, police will clearly be in violation of the 1st Amdendment right to Freedom of Religion and Assembly. Searches and Stops without Reasonable Suspicion violate the 4th Amendment and Terry v. Ohio, and Racial Profiling. So, is Rahm going to stand next to the cop who has to list his assets at deposition? THE MEDIA HAS MADE THESE MEN MORE THAN WHAT THEY REALLY ARE: RAHM MAJORED IN COMMUNICATION AND BALLET, he is not a Constitutional Scholar. The U.S. Constituion still applies, even in "Crook" County. This type of heavy handed enforcement is absurd and illegal as it is currently proposed.

in my opinion, it would be easier to just set up a metal detector at the main entrance like they do at most the Highschools. That would be better than an a frisk of any sort.
