LEOSA and College?


Are Universities considered state property which can be excluded from otherwise authorized carry under LEOSA? My son will be going to University of Nebraska, Lincoln. Course they have a "no guns" allowed policy. I had called down to the campus police and of course the answer was "No, you can't carry but you can check in the weapon at our office"...any thoughts?

Read LEOSA. There is no question about it.

"(b) This section shall not be construed to supersede or limit the laws of any State that-- (2) prohibit or restrict the possession of firearms on any State or local government property, installation, building, base, or park."

A lot of people would just like to think that we don't need to fight fire with fire. Guns are not the answer, you do not stop the crazy people of the world with bullets, you use words and ideas. Just another opinion. I know I always post the same arguments.

bop222, I would think that the college would be a state building under LEOSA. As has been posted before, don't advertise you are carrying and you will not have to find out!!

And who the heck is this Incustody???

It's a state university. Wouldn't that make it state property?

I would pose the question to the univerisity police. Unless the liberal college administration has their hands in the police policies I am willing to bet it wouldn't be a problem.

I've carried mine concealed while in the court house and had no problems. I simply show the security folks my ID and they wave me around the metal detector. By Alabama state law, CCW's are not valid in vourt houses, but they are on school grounds including state colleges and universities.

I've seen where some campus police aren't allowed to carry firearms on campus in some states. Weirdness abounds in some places, of course, I'm sure those places would think Alabama's laws are weird.

Most state colleges and universities accept federal funds, I don't know if that would have any bearing on the issue, but it seems like it should. The thing that should be addressed, I think, is what does the state law have to say about it? Most states have laws authorizing LEO's to carry firearms, does Nebraska? If so, and the individual in question is a LEO, I'd say that should pretty well settle it.

What I find interesting in this is the Nebraska Attorney General's Office rendered a decision that the Univ of Nebraska is NOT considered a school in the context of the exceptions for carrying a concealed firearm with the NE state permit. The college requested that opinion so they wouldn't have to post signs all over the college indicating that carrying wasn't allowed. I had written the AGs office asking how that opinion affects LEOSA, if at all...see if a response gets sent.

The lengths the misguided bureaucrats will go to restrict one's freedoms in some areas are just plain sickening. If the University isn't a "school" what does the AG say it is? Good luck and let us know what the AG's answer is.
