what about the case of "care and custody"? A person is not not under arrest but, the officer s conducting an investigation and thefore can detain a person and they are not free to leave because they are in the care and custody of that officer pending the investigation where consnet to search is asked? It happens everyday on federal property where a pesron voluntarly enters and therfore is subject to this type of "stop" and consider this Washington, DC is a federal city it is a distrcit that falls under federal guidelines. Any person arrested in DC is charged as such and all persons are charged by the US Govt. ie United States of America Vs. John Smith.........??? Something to ponder when dealing with private residences on federal property.

Consent is a word which is subjective, depending on which side of consent you are on will determine how the word consent is interpreted.
