DA Won't Prosecute Officer Who Kicked Gang Member In the Head

El Monte police officer Geroge Fierro won't be prosecuted for kicking a gang member in the head at the end of a pursuit, the San Gabriel Valley Tribune reports.

Similarly, fellow officer James Singleterry won't face charges in the May 13 incident that was aired on live television. Watch the video at POLICE TV.

In his report declining to file charges, Los Angeles County Deputy District Attorney Jason Lustig wrote that Fierro may have been provoked into using a distraction blow when he kicked Richard Rodriguez. The blow was meant to stun or distract Rodriguez rather, Lustig added.

Finally a D.A. with commen sense. You have a Police Officer that has devoted his life to be a benifit to society and a credit to the human race. Then there's the total waste of space gang banger that has done nothing but be a disease to humanity. Then Police Officer kick's said scum bag in the head........."SO WHAT"!!!!! They should have fed him to a wood chipper
